GJ PIM Events — Terms & Conditions of Ticket Supply

GJ PIM Events is the trading name for Townsend Wine Merchants Ltd. This page (together with the documents expressly referred to on it) sets out information about Townsend Wine Merchants Ltd (referred to as “we”, “us” or “our”) and the legal terms and conditions (“Terms”) on which we sell tickets (“Tickets”) for events (“Events”) listed on www.gjpimevents.com (“our site”) to you.

These Terms apply to any contract between you and us for the sale of Tickets (“Contract”). Please read these Terms carefully and make sure that you understand them before buying any Tickets from our site. By buying any Tickets, you agree to be bound by these Terms and the other documents expressly referred to in them.

You should print a copy of these Terms for future reference.

We may amend these Terms from time to time as set out in clause 9. Every time you buy Tickets, please check these Terms to ensure you understand the terms which apply at that time.

These Terms, and any Contract between us, are only in the English language.

1. Information About Us

1.1. We operate our site. We are Townsend Wine Merchants Ltd, registered in England and Wales, with our registered office and main trading address at Homelands, Upper Dunsforth, York, YO26 9RU, England.

2. Tickets and Events

2.1. Tickets are sold subject to availability. We may limit the number of Tickets sold per person/order.

2.2. Event details (including date, time, location, line-up, format, inclusions and any age restrictions) are described on the relevant Event listing on our site. Event details may change and we will use reasonable efforts to notify Ticket holders of material changes.

2.3. Some Events may include items as part of the ticketed experience (for example: a glass of wine, food, or merchandise). Where included, this will be described on the Event listing. Any included items:

  • may be subject to reasonable substitution (for example, a comparable product where something becomes unavailable); and

  • may be removed/withheld where entry is refused or a guest is removed for breach of these Terms (including age/ID rules), with no refund as set out in clause 5.

2.4. Tickets are for admission to the Event only (and any inclusions described in the listing). Travel, accommodation and other costs are your responsibility unless stated otherwise on the Event listing.

2.5. We may refuse entry or remove a person from an Event if, in our reasonable opinion, their behaviour is unsafe, disruptive, or likely to damage property or spoil the Event for others. In those circumstances, no refund is due.

3. Use of Our Site

Your use of our site is governed by our Terms of Website Use. Please read them, as they include important terms which apply to you.

4. How We Use Your Personal Information

We only use your personal information in accordance with our Privacy Policy. Please read it, as it includes important terms which apply to you.

5. Age Restrictions and ID

5.1. Some Events are 18+. Others are not age-restricted. The applicable age restriction will be stated on the Event listing.

5.2. For 18+ Events, we may require valid photo ID at the venue (for example, passport or driving licence). If you cannot provide acceptable ID when requested, we may refuse entry and/or restrict service (including alcohol service).

5.3. No refund (full or partial) will be provided where:

  • an under-18 purchases or attempts to use a Ticket for an 18+ Event; or

  • a person (including someone over 18) is refused entry and/or refused part of the included service because they cannot provide valid photo ID when requested.

5.4. Where an Event is not age-restricted, children/young people must be supervised as appropriate. Venue rules may also apply and may further restrict access for safety/legal reasons.

6. If You Are a Consumer

6.1. If you are a consumer, you have legal rights in relation to services that are not provided with reasonable care and skill or as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms affects your legal rights.

7. If You Are a Business Customer

7.1. If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you purchase Tickets.

7.2. These Terms and any document expressly referred to in them constitute the entire agreement between you and us relating to Ticket purchases.

8. How the Contract Is Formed Between You and Us

8.1. After you place an order, you will receive an email acknowledging that we have received it. This does not mean your order has been accepted.

8.2. We will confirm acceptance by sending you an email confirming your Ticket purchase and providing your Ticket(s) or confirmation details (“Order Confirmation”). The Contract is formed when we send the Order Confirmation.

8.3. If we are unable to supply Tickets (for example because the Event is sold out or there is a system error), we will inform you as soon as reasonably possible and refund any amounts paid for the unavailable Tickets.

9. Our Right to Vary These Terms

9.1. We may revise these Terms from time to time, including to reflect:

  1. changes to how we accept payment; or

  2. changes to relevant laws and regulatory requirements.

9.2. The Terms in force at the time you buy Tickets apply to that Contract.

10. Cancellations and Refunds (Customer Cancellations)

10.1. If you wish to cancel your Ticket purchase, you must contact us using the details on our Enquiries page on www.gjpimevents.com/enquiries. Cancellations are effective from the time we receive your cancellation request.

10.2. More than 14 days before the Event: You are entitled to a full refund for the Ticket(s) cancelled.

10.3. From 14 days up to 72 hours before the Event: We may offer a partial refund at our discretion. Any partial refund amount will be confirmed to you in writing.

10.4. Less than 72 hours before the Event (including no-shows): No refund is available.

10.5. Refunds (where applicable) will be made to the original payment method and processed as soon as reasonably practicable.

10.6. This clause 10 does not limit any refund required by law in circumstances where an Event is cancelled by us or materially changed, as described in clause 11.

11. Event Changes, Cancellations and Refunds (Our Changes)

11.1. We may need to change an Event (for example, the venue, timings, content, or a speaker/performer). We will use reasonable efforts to notify Ticket holders of material changes.

11.2. If we cancel an Event, we will offer Ticket holders a full refund of the Ticket price paid (or, where offered, the option to transfer to a rescheduled date or alternative event). If you choose a refund, it will be processed as soon as reasonably practicable.

11.3. Unless required by law, we are not responsible for additional costs you may incur (for example travel, accommodation, or third-party booking fees).

12. Ticket Transfer / Resale

12.1. Tickets cannot be resold or transferred without our express permission.

12.2. We may refuse entry where we reasonably believe Tickets have been resold or transferred without permission.

13. Price and Payment

13.1. Ticket prices are as quoted on our site at the time of purchase.

13.2. It is always possible that, despite our reasonable efforts, some Tickets may be incorrectly priced. If we discover an error in the price of Tickets you ordered, we will inform you and give you the option of continuing at the correct price or cancelling for a full refund.

13.3. Payment is taken at the point of purchase (unless otherwise stated in the checkout process).

14. Our Liability If You Are a Business

14.1. Nothing in these Terms limits or excludes our liability for:

  1. death or personal injury caused by our negligence;

  2. fraud or fraudulent misrepresentation; or

  3. any liability that cannot legally be limited or excluded.

14.2. Subject to clause 14.1, we will not be liable for any indirect or consequential loss, or for loss of profits, sales, business, revenue, goodwill, or business opportunity.

14.3. Subject to clause 14.1, our total liability to you in respect of all losses arising under or in connection with a Contract shall not exceed the total Ticket price paid by you for the relevant Tickets.

15. Our Liability If You Are a Consumer

15.1. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence.

15.2. We do not exclude or limit our liability for:

  1. death or personal injury caused by our negligence;

  2. fraud or fraudulent misrepresentation; or

  3. any liability that cannot legally be limited or excluded.

16. Events Outside Our Control

16.1. We are not liable for any failure to perform, or delay in performance, of our obligations caused by an event beyond our reasonable control (“Event Outside Our Control”).

16.2. If an Event Outside Our Control affects an Event, we will contact Ticket holders as soon as reasonably possible and will explain any changes, rescheduling, or refund options available.

17. Communications Between Us

17.1. When we refer to “in writing”, this includes email.

18. Other Important Terms

18.1. We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights.

18.2. You may only transfer your rights or obligations under these Terms if we agree in writing in advance (see clause 12 regarding Tickets).

18.3. Each paragraph of these Terms operates separately. If any court decides that any part is unlawful or unenforceable, the remaining parts remain in full force and effect.

18.4. If we do not insist that you perform any of your obligations, or if we delay in enforcing our rights, that does not mean we waive our rights.

18.5. These Terms are governed by English law. Any dispute or claim arising out of or in connection with these Terms or a Contract will be governed by English law and the courts of England and Wales will have exclusive jurisdiction.
